1. Acceptance of Terms

By accessing and using the website https://www.elaeisgardens.com/ ("the Website"), you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree with any part of these Terms, you must not use our Website or make any bookings for services.

SD Guthrie ELAEIS GARDENS Sdn Bhd (Company Registration No. 21025-P), and our operational premises, ELAEIS GARDENS, are collectively referred to as "We," "Us," or "Our."

2. Services Offered

The Website provides information, pricing, and booking facilities for services including, but not limited to:

  • Accommodation (Executive Room, Heritage Bungalow, Dormitory, etc.)
  • Golf and Sports Activities
  • Educational Visits and Plantation Experience Centre Tours
  • Venue Hire for Meetings and Events
  • Food and Beverage services

3. Booking and Reservation Terms

3.1 Contract Formation

A booking is considered confirmed and a binding contract is formed when:

  1. We have received the required 50% or full payment.
  2. We have issued a written Booking Confirmation or Itinerary.

3.2 Pricing and Payment

  • All prices are quoted in Ringgit Malaysia (RM) unless otherwise stated.
  • Prices are subject to change without prior notice, but any change will not affect confirmed bookings already paid for in full.

3.3 Deposits and Final Payment

  • Accommodation/Activities: A 50% deposit is required at the time of booking. The remaining balance is due 3 business days prior to the arrival/check-in date.
  • Events/Venue Hire: Specific deposit and payment schedules will be outlined in the separate Event Contract.

4. Cancellation and Refund Policy

Cancellation requests must be made in writing via email to ecogardens@sdguthrie.com / Event Representative on-duty The following charges apply based on when the cancellation is received:

Timing of Cancellation (Prior to Check-in/Event Date) Cancellation Fee (of Total BookingValue)
Between 14 and 7 days [e.g., 50% of total booking value]
Less than 3 days (or No-Show) [e.g., 100% of total booking value]

5. Changes and Amendments

  • Any reduction in guest numbers or room nights may be treated as a partial cancellation and subject to the fees outlined in Clause 4.

6. Check-in and Check-out

  • Check-in Time: 3:00 PM
  • Check-out Time: 12:30 PM
  • Early check-in or late check-out is subject to availability and may incur additional charges.

7. Force Majeure (Unforeseen Circumstances)

Neither party shall be liable for any failure or delay in performing its obligations under these Terms where such failure or delay is caused by an event beyond reasonable control ("Force Majeure Event"). This includes, but is not limited to, acts of God, extreme weather, natural disasters, epidemics, pandemics, government shutdowns, or civil unrest.

If a Force Majeure Event occurs:

  • We will attempt to reschedule the booking at no penalty.
  • If rescheduling is impossible, We may offer a credit for future use or a refund, ecoverable costs incurred by Us up to the date of the event.

8. Use of the Premises and Assumption of Risk

  • Ecotourism & Activities: You acknowledge that your participation in golf, sports, educational visits, and other recreational activities carries inherent risks. You agree to assume all risks associated with your voluntary participation.
  • Safety: All guests must strictly adhere to the safety guidelines, rules, and instructions given by Our staff for all activities and use of facilities.
  • Damage: Guests are liable for any damage caused to Our property, facilities, or equipment by their negligence or willful act.

9. Intellectual Property

The content, design, logo, photos, and trademarks on the Website are the exclusive property of SD Guthrie ELAEIS GARDENS Sdn Bhd or its licensors and are protected by copyright and intellectual property laws. You may not reproduce, modify, distribute, or otherwise use any content from the Website without Our prior written permission.

10. Limitation of Liability

To the fullest extent permitted by Malaysian law, We shall not be liable for any direct, indirect, incidental, or consequential damages, including loss of profits, arising from:

  1. Your access to or use of the Website.
  2. Any inaccuracies or errors on the Website.
  3. Any injury, loss, or damage to persons or property arising from or related to your stay or participation in activities on Our premises, except in cases of Our gross negligence or willful misconduct.

11. Indemnification

You agree to indemnify, defend, and hold harmless SD Guthrie Ecogardens Sdn Bhd, its officers, directors, and employees from and against any and all claims, damages, costs, and expenses (including legal fees) arising from your breach of these Terms or your use of the Website or Our services.

12. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of Malaysia. You irrevocably agree to submit to the exclusive jurisdiction of the courts of Malaysia for any dispute or matter arising out of or relating to these Terms.
